Welcome to VoteSecure. These Terms and Conditions outline the rules and regulations for the use of our E-Voting Platform. By registering an organization or accessing this platform, we assume you accept these terms and conditions in full.

1. General Usage and Organizational Responsibilities

Organizations ("Tenants") using this platform to conduct elections are solely responsible for:

  • The accuracy, legality, and integrity of the voter rolls and member data uploaded to the system.
  • Ensuring that the election rules, bylaws, and constitutional requirements of their respective organizations are adhered to.
  • Obtaining necessary consent from members to receive automated communications (Email, SMS, WhatsApp) regarding election notifications.

2. Voter Anonymity and Data Integrity

The platform is designed using cryptographic hashing to ensure that once a ballot is cast, it cannot be tampered with. However:

  • The platform guarantees structural anonymity of the vote payload itself, but organizational administrators have access to metadata (e.g., who has voted, audit logs) to prevent double voting.
  • VoteSecure is not responsible for data breaches resulting from compromised administrator accounts, weak passwords, or organizational negligence.

3. Service Availability and "As-Is" Disclaimer

This service is provided on an "AS IS" and "AS AVAILABLE" basis.

While we strive for 99.9% uptime, we make no warranties, expressed or implied, that the service will be uninterrupted, error-free, or entirely secure from malicious cyber-attacks. VoteSecure disclaims all liability for any disruption in service that may delay or impact an ongoing election.

4. Limitation of Liability

In no event shall VoteSecure, nor any of its developers, directors, or affiliates, be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this platform.

Specific exclusions of liability include, but are not limited to:

  • Disputes arising between an organization and its members regarding election outcomes.
  • Failure to deliver critical notifications (SMS, Email, WhatsApp) due to third-party gateway outages or carrier filtering.
  • Decisions made by the organization based on the statistical results provided by the platform.

5. Communication Gateways

Organizations utilizing the SMS, Email, and WhatsApp communication features must strictly adhere to the anti-spam regulations of their local jurisdictions (e.g., TRAI regulations in India, GDPR in Europe). Messages must only be dispatched during legally permitted business hours, and the platform actively enforces these windows. Any attempt to bypass these restrictions or use the platform for unsolicited marketing will result in immediate account termination.

6. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with local jurisdictional laws, and you submit to the non-exclusive jurisdiction of the state and federal courts located in for the resolution of any disputes.
